The Babyandmom.ma showroom, at the same address, is the collection point for orders.
ARTICLE 1: PRODUCTS
1.1. PREAMBLE
The following general terms and conditions of sale govern all transactions concluded on the Babyandmom.ma website. Any order placed on this website implies the customer’s unconditional and irrevocable acceptance of these terms and conditions.
We provide on our website all the information relating to our products, with descriptions and images that bring you closer to the product you wish to purchase.
1.2. PURPOSE
This contract is a distance contract whose purpose is to define the rights and obligations of the parties in connection with the sale of products of the company KSSK COMPANY over the Internet, via the secure online payment platform of the Centre Monétique Interbancaire.
Babyandmom.ma is a service and a trade mark registered by KSSK COMPANY.
1.3. AVAILABILITY
The customer may, at any time, order the products offered for sale on Babyandmom.ma at the time they are viewed and subject to available stock. Should a product be unavailable, the customer will be informed immediately by e-mail or by telephone of the partial delivery of their order or of its cancellation.
Babyandmom.ma reserves the right to modify, or to cease marketing, certain products offered, at any time. Orders accepted before such modifications take effect are, however, not affected.
1.4. PRICES
The prices applied are those displayed on the website at the time the order is placed. They are stated in Dirhams, inclusive of all taxes, excluding delivery charges.
The amount of the delivery charges will be added to the price of the selected products at the end of the order, on the page summarising the customer’s purchases and in the order confirmation e-mail.
Babyandmom.ma reserves the right to change the prices of the products offered, at any time and without notice. Orders accepted before the price change takes effect are, however, not affected.

ARTICLE 3: ORDERS & PAYMENT
3.1. ORDERING PROCESS
The customer may place their order at any time of the day on the Babyandmom.ma website, 24 hours a day, 7 days a week. Once the products to be purchased have been chosen, the order proceeds as follows:
• Adding the products to the basket;
• Logging in OR completing the contact form to create an account;
• Accepting the terms of use;
• Choosing the payment method.
These terms of use, which the customer accepts at the time of ordering, form a contractual whole governing the relationship between Babyandmom.ma and the customer.
The customer may track their order by contacting Customer Service, or by consulting their account on our website.
3.2. ORDER CONFIRMATION
No order shall be considered final until it has been confirmed by the Babyandmom.ma Customer Service. Upon receipt of their order, the customer receives an automatic e-mail summarising the details of their purchase; they are then contacted by telephone in order to confirm the delivery address and time slot.
Babyandmom.ma is fully entitled to refuse any abnormal order placed in bad faith.
3.3. PAYMENT
To pay for your order, you choose the payment method from among those offered by Babyandmom.ma on the payment page.
In this case, the transaction is submitted for debiting from your account on the day following the date of delivery confirmation.
Your online payments are secured by the Centre Monétique Interbancaire (CMI), which provides a fully secure payment service.
The customer may pay online by Moroccan bank card on Babyandmom.ma immediately after placing their order, or in cash upon receipt of their order.
The Consumer warrants to the Company that they hold any authorisations that may be required to use the payment method they have chosen when validating their order.
In the event of payment by bank card, the provisions relating to fraudulent use of the means of payment set out in the agreements concluded between the Consumer and the card issuer and between the Company and its bank shall apply.
The data recorded on the CMI platform on behalf of Babyandmom.ma constitute proof of all commercial transactions concluded between the customer and the Babyandmom.ma website.
Delivery charges are included in the total amount payable.
3.4 PROOF OF TRANSACTIONS PAID BY BANK CARD
The data recorded by the CMI on the online payment platform on behalf of Babyandmom.ma constitute proof of the commercial transactions concluded between you and Babyandmom.ma.
ARTICLE 4: DELIVERY
Delivery takes place within the following times, expressed in working hours from confirmation of the order: 2 to 24 hours in Casablanca (courier); 6 to 24 hours in Bouskoura, Dar Bouazza and Nouaceur (courier); 24 to 48 hours for the rest of Morocco (carrier). Sundays and public holidays are not counted. Delivery costs 20 MAD in Casablanca and 35 MAD in other areas; delivery is free on orders of 399 MAD or more. Pickup at the Palmier Maarif showroom is free.
Every order received must be checked upon delivery and in the presence of the delivery person in order to verify the condition of the products. Should the customer receive a damaged parcel or an incomplete order, they must contact us immediately at: contact@babyandmom.ma.
The customer may enquire about the progress of their delivery by contacting Customer Service.
ARTICLE 5: RIGHT OF WITHDRAWAL, RETURNS AND EXCHANGES
Under Law 31-08, you have 7 days from receipt of the product to exercise your right of withdrawal, namely to return the product without giving reasons for your decision. The product must be returned unused, in its original packaging. Damaged, soiled or incomplete products will under no circumstances be taken back.
Because of their nature, the right of withdrawal cannot be exercised for:
- hygiene and personal care products, teats, bottles, breast pumps and breastfeeding accessories that have been opened or unsealed after delivery;
- opened food products, in particular infant formula, baby food jars and cereals, as well as perishable goods;
- personalised items or items made to order (engraving, embroidery, etc.).
If you exercise your right of withdrawal, Babyandmom.ma will refund all sums paid no later than 15 days after you exercise this right, using the same means of payment as that used for the order, or by bank transfer for orders paid on delivery.
The Customer may request an exchange of all or part of the Products in their order, subject to sending an e-mail or a message to the Company’s customer service on the day of delivery or, at the latest, on the first working day following delivery. After this period, the Company will under no circumstances be able to process the exchange request.
The exchange may take the form of an exchange for a different size or colour within fifteen (15) days of the date on which the Company receives the parcel. The exchange may also give rise to a credit note to be used within three (3) months of the date of purchase.
ARTICLE 6: DATA CONFIDENTIALITY
The information requested from you is necessary for processing your order and is treated confidentially.
You have a right to rectify the data concerning you.
ARTICLE 7: INTELLECTUAL PROPERTY
All the elements making up the content of the Babyandmom.ma website – texts, comments, drawings, photographs, illustrations, logos, graphics, etc. – are the exclusive property of Babyandmom.ma; the customer is entitled only to consult the website.
Except for information purposes for personal and private use, any total or partial reproduction or representation of the Babyandmom.ma website or of the elements making up its content is strictly prohibited and constitutes infringement.
ARTICLE 8: GOVERNING LAW - DISPUTES
These General Terms and Conditions of Sale are governed by Moroccan law. In the event of a dispute, Babyandmom.ma and the customer undertake to seek an amicable solution before taking any legal action; failing this, the dispute shall be submitted to the Moroccan courts, which shall have exclusive jurisdiction.
ARTICLE 9: WARRANTY
All products sold on Babyandmom.ma are guaranteed against manufacturing defects and material defects. The duration of this warranty is at least one year (from the date of the invoice). Should returned equipment prove not to be defective, transport and handling charges may be invoiced to the customer. This warranty does not cover damage resulting from accidents, misuse or negligence.
ARTICLE 10: FORCE MAJEURE
Babyandmom.ma is bound to perform its obligations only insofar as no event of force majeure prevents it from doing so.
ARTICLE 11: DELETION OF DATA
If you would like your personal data to be deleted from our systems, please contact us at service-client@babyandmom.ma . We will process your request as soon as possible, in accordance with the legal requirements on data retention.
